Applicable statutes of limitations and substantive requirements differ from US law. Strict compliance is critical in order to preserve creditors’ rights. • Pierce the corporate veil: Insolvency or bankruptcy of a corporate debtor is not always a bar to recovery. German law provides for many exceptions which allow creditors to pierce the corporate veil and establish personal liability of officers and directors who may be pursued in their individual capacity.
